(2)The articles of incorporation and business program shall not include any false statements;
(3)The Organization shall be seen to have adequate planning so that planned measures for implementing improvements around the airport may be effectively realized, and to have commensurate managerial and technical basis to effectively actualize the abovementioned plan;
(4)It shall be recognized that the management of business will be definitely carried out in addition to those matters specified under the preceding subparagraph, and will contribute to the prevention and alleviation of disturbance arising from aircraft noise in the area around the airport for the improvement of its environment, and also for the improvement in the quality of life.
Article 28. The Minister of Transport shall, upon giving approval under the provisions of the preceding Article, nominate without delay one candidate respectively for the Chairman of the Board of Directors and the auditor of the Organization, from among persons recommended by the promoters.
2. The candidates for the positions of chairman of the Board of Directors and auditor, nominated under the provisions of the preceding paragraph, will be appointed respectively as the Chairman of the Board of Directors and the Auditor under the provisions of Article 34 paragraph 1 (Appointment of Chairman of Board of Directors and Auditor) at the time of the formation of the Organization.
(Transfer of Business)
Article 29. The promoters shall, when a candidate for Chairman of the Board of Directors has been nominated under paragraph 1 of the preceding Article, transfer the business without delay to said Chairman of the Board of Directors.
2. The candidate for the Chairman of the Board of Directors shall, when taking over business under the provisions of the preceding paragraph, request without delay the payment of investment under the provisions of Article 21 paragraph 1 (capital for Organization) from the Government and the local pubic bodies which have accepted the application for investment.
(Registration of Establishment)
Article 30. The candidate for Chairman of the Board of Directors shall, when receiving payment of investment under paragraph 2 of the preceding Article, register without delay under the provisions of a Cabinet Order.
2. The Organization will be founded by the registration of establishment.
